Caleb Gannon will be charged with assault and battery months after he ran through traffic and tackled pro-Israel activist Scott Hayes in Newton, Massachusetts, a source with knowledge of the situation told The Daily Wire.

Gannon, 31, will be charged in Newton District Court on Friday. His arraignment is set for December 30. 

Gannon attacked Hayes on September 12 while the veteran was participating in a demonstration with six to eight other pro-Israel activists by holding American and Israeli flags next to a busy intersection. 

Gannon has a history of inflammatory social media posts where he advocated for the destruction of the United States, refused to denounce Hamas, and labeled murdered American hostage Hersh Goldberg-Polin as a terrorist who “got what he deserved.”

“I don’t condemn Hamas. I condemn my family,” Gannon wrote in one post about the terrorist group that killed, raped, or took hostage over 1,000 citizens from Israel on October 7.

Gannon’s father told the police that his son is mentally unstable and possibly autistic after the incident, The Boston Globe reported.

At the start of the incident, Gannon shouted his anti-Israel views at the group from across a street, calling the pro-Israel demonstrators “sick” and accusing them of “defending genocide.”

He then began to charge across the street until Hayes stepped onto the street with the hand on his waistband where his lawfully possessed firearm was secured in a holster under his shirt, according to a motion filed by Hayes’s attorney. 

“Hayes did not brandish or even remove his gun from this holster, yet Gannon knew that Hayes had a gun, shouting ‘Are you carrying a f***ing gun?” the motion reads. “Hayes acknowledged that he did have a gun.”

Gannon backed away while making obscene gestures while Hayes started to dial 911 on his phone. This is when Gannon rushed through traffic and tackled Hayes, as caught on a video provided to The Daily Wire.

According to court documents, Hayes was face down on the sidewalk while Gannon was on top of him and choking him with his right arm, while trying to reach for Hayes’s gun with his left. Hayes then unholstered his gun and fired one shot at Gannon’s midsection. The documents go on to claim that Gannon still tried to grab Hayes’s gun after being shot and at one point “was able to turn the gun barrel toward Hayes’ face.”

In another video after the incident, Hayes used his military training to give first aid to Gannon while telling bystanders to call 911.

“Hayes suffered injuries to his face, hand, arm and leg that left him bleeding and with a severe neck injury,” the motion states.

Hayes said he needed to have surgery because of the injury he suffered on his neck.

Hayes was charged shortly after the incident with assault and battery with a dangerous weapon and released on a $5,000 bail. He was initially given a curfew and restrictions on being in Newton as well as being ordered to wear a GPS ankle monitor before he petitioned to have it removed. Hayes is still forbidden from possessing firearms, though his firearm was lawful at the time of the shooting.

Hayes pleaded not guilty and said he acted in self-defense. Hayes will return to court on January 27.

“I’m frustrated it took 84 days for Caleb Gannon to be charged,” Hayes said. “I’ve lost my job and many other aspects of my life have been ruined. The video evidence against him was overwhelming and he should have been charged sooner.”

Before being fired, Hayes worked for a company where he provided natural gas leak detection, leak surveys, and inspections for the large Massachusetts utility provider, National Grid. After the incident, National Grid refused to let him work on their account, according to Hayes.

Hayes, though not Jewish, has frequently partook in pro-Israel demonstrations since Hamas’ October 7 attack. He says it’s important to use his voice to advocate for the release of Israeli hostages in Gaza.

“If my life has to be ruined for trying to help the Jewish people to survive, then that’s the price,” he previously told The Daily Wire. “It’s a much bigger issue than me. What happened to me brought a lot of local Jewish people together and got them out and active because of the reality of what’s happening.”

A GoFundMe for Hayes has raised more than $267,000 since the incident.
